General Terms and Conditions (GTC)

Last updated: 7 October 2026

1. Provider and general information

1.1. The online shop at www.kaffemik.live ("online shop") is operated by Kaffemik GmbH, Zollergasse 5/2, 1070 Vienna, Austria, phone +43 660 2712997, email coffee@kaffemik.live, company register no. FN 605692 z, Commercial Court of Vienna, VAT ID ATU79573515 ("provider").

1.2. These general terms and conditions ("GTC") apply to orders, sales and deliveries of products, in particular coffee, coffee equipment and merchandise, as well as to coffee subscriptions, vouchers and tickets for workshops, cuppings and other events ("products") offered in the online shop.

1.3. The language of the contract is German. This English version is provided for convenience; in the event of any discrepancy, the German version prevails.

2. Scope

2.1. These GTC apply if the buyer is a consumer within the meaning of § 1 of the Austrian Consumer Protection Act (KSchG) ("customer").

3. Changes to the GTC

3.1. The provider reserves the right to amend these GTC. The GTC in force at the time the contract is concluded apply to each sale. For ongoing coffee subscriptions, section 9.5 also applies.

4. Customer account

4.1. The customer can create a customer account in the online shop. Creating a customer account requires the customer to provide certain information. In the customer account, the customer can view their orders and manage ongoing coffee subscriptions.

4.2. Orders can also be placed without a customer account.

5. Order, order confirmation, conclusion of contract

5.1. The ordering process consists of the following steps:

  1. Selecting the desired product and, where applicable, the variant (e.g. weight, date or value) and clicking "Add to cart".
  2. In the cart (icon at the top right), the customer can change quantities or remove products and proceed to checkout via "Check out".
  3. At checkout, the customer enters their email address, chooses between shipping and pickup, enters the delivery and, if applicable, billing address and selects the shipping method and payment method. Alternatively, the customer can use an express checkout (e.g. Apple Pay, Google Pay, PayPal or Shop Pay), in which case these details are taken from the respective payment service.
  4. Via "Review order", the customer receives a summary of the order with all products, the total price including VAT and the shipping costs. The customer can identify and correct input errors there and in the previous steps at any time.
  5. By clicking the final order button labelled "Order with obligation to pay" or an equivalent wording, the order is submitted bindingly.

5.2. The products and prices shown in the online shop constitute an invitation to the customer to submit a binding offer to the provider to purchase the products ("order"). By clicking the order button, the binding order is transmitted to the provider. Images and drawings of the goods are approximations only, unless they are expressly stated as fixed values for the product. The customer accepts minor and objectively justified changes.

5.3. The provider will promptly send the customer a confirmation to the email address provided that the order has been received ("order confirmation"). This order confirmation does not constitute acceptance of the order but merely confirms its receipt.

5.4. The contract is concluded when the provider accepts the order. Acceptance takes place by dispatch of the ordered goods, with a shipping confirmation sent being deemed acceptance; for pickup, by notification that the goods are ready for collection; for tickets and vouchers, by sending them by email. If no separate confirmation is sent, receipt of the goods by the customer is decisive.

5.5. If the provider cannot accept an order, for example because a product is no longer available, the provider will inform the customer without delay and promptly refund any payments already made.

5.6. The customer must ensure that all information provided in an order, in particular the data required for shipping, is accurate, correct and up to date, and must notify the provider of any changes without delay.

5.7. The provider stores the contract text. The customer receives the details of the order with the order confirmation by email. These GTC can be accessed in the online shop at any time and can be saved and printed.

5.8. After conclusion of the contract, the provider sends the customer an electronic invoice. The customer agrees to receive an electronic invoice.

6. Prices and payment

6.1. All prices are stated in euros including VAT but excluding shipping costs, unless stated otherwise. Shipping costs are shown to the customer at checkout before the order is placed.

6.2. Payment in the online shop can be made using the following payment methods: credit and debit card (Visa, Mastercard, Maestro, American Express, UnionPay), PayPal, Klarna, eps bank transfer, Apple Pay, Google Pay, Shop Pay and MobilePay. The payment methods displayed may vary depending on the device, delivery country and product; for coffee subscriptions, only payment methods that allow recurring charges are available.

6.3. The purchase price is due when the order is placed and is charged via the selected payment method. Section 9.2 applies to coffee subscriptions. For payments via Klarna or PayPal, the terms of the respective payment service also apply.

7. Delivery and pickup

7.1. The shipping methods and delivery countries stated by the provider at checkout are available to the customer. For orders of €50 or more, shipping within Austria is free. For orders under €50 and for deliveries outside Austria, shipping costs are calculated at checkout; within the EU they amount to between €5.00 and €29.00 per shipment.

7.2. Delivery dates stated by the provider are based on the information provided by the commissioned shipping service. Unless a different delivery date is stated for the respective product, products are delivered to the customer within 30 days of conclusion of the contract at the latest.

7.3. If a delivery date cannot be met due to force majeure, industrial action or other events beyond the provider's control, the delivery date is extended appropriately for the duration of the obstacle. The provider will inform the customer of the beginning and end of such circumstances as soon as possible.

7.4. If the customer is in default of accepting the products, the warranty period for the provider's performance begins at that point.

7.5. If the customer chooses pickup at checkout, the provider will inform the customer by email as soon as the ordered goods are ready for collection. The goods can then be collected at the stated pickup location during the stated times. No shipping costs are charged for pickup.

8. Retention of title

8.1. The provider retains title to the products until the customer has paid the purchase price and ancillary costs (in particular shipping costs) in full.

9. Coffee subscription

9.1. With the coffee subscription ("subscription"), the customer regularly receives the quantity of coffee described for the subscription (currently 2 bags per month). The provider selects the coffees.

9.2. The first payment is made when the order is placed; the first delivery is shipped or made ready for pickup immediately afterwards. All further payments are charged to the stored payment method on the 4th of each month, and further deliveries are shipped or made ready for pickup on the 4th of each month. If the order is placed before the 4th of a month, the second payment is charged on the 4th of the same month.

9.3. The subscription has no minimum term and can be cancelled by the customer at any time without giving reasons, in the customer account (subscription management) or by email to coffee@kaffemik.live. If the cancellation is received before the next billing date, no further charges or deliveries are made from that date onwards. Deliveries that have already been charged will still be shipped or made ready for pickup.

9.4. A subscription purchased as a gift with a fixed term (e.g. 3, 6 or 12 months) ends automatically at the end of the selected term without the need for cancellation.

9.5. If the costs of green coffee, packaging or shipping change, the provider may adjust the price of an ongoing subscription for future deliveries; cost reductions are passed on in the same way. The provider will notify the customer of a price change by email at least 30 days before it takes effect and will point out the customer's right to cancel the subscription free of charge at any time until then.

10. Workshops, cuppings and events

10.1. Tickets entitle the holder to attend the booked event on the booked date for the stated number of people. Location, duration and content are set out in the respective product description.

10.2. Rebooking to another date is free of charge up to 7 days before the booked date, unless stated otherwise for the respective offer. There is no right of withdrawal for events on a date fixed at the time the contract is concluded (see cancellation policy).

10.3. If the provider has to cancel an event, for example due to illness or too few participants, the provider will offer the customer an alternative date or refund the amount paid.

10.4. Workshops at the customer's home (e.g. Home Espresso Workshop) take place by appointment. The customer provides the equipment stated in the product description (e.g. espresso machine and grinder). For appointments outside Vienna, a travel flat rate agreed in advance may apply.

11. Vouchers

11.1. Vouchers for the online shop are redeemed at checkout in the field for discount codes and gift cards. Café vouchers are sent as a PDF by email and can be redeemed in the café at Zollergasse 5, 1070 Vienna. Workshop vouchers entitle the holder to attend the stated workshop or up to the stated value; the date is arranged subject to availability.

11.2. Vouchers cannot be exchanged for cash. Any unused remaining balance is retained.

12. Provider default

12.1. If the provider is in default with its performance, the customer must first request the provider to perform within a reasonable grace period of two weeks. If the provider does not perform within this period, the customer may withdraw from the contract or continue to demand performance.

13. Warranty

13.1. Kaffemik GmbH provides warranty in accordance with the statutory provisions. For complaints, please contact coffee@kaffemik.live.

13.2. The provider may request that the customer, where reasonable for the customer, send the defective products to the provider, in which case the provider bears the risk of shipment and the costs of return. The customer is asked to report delivered goods with obvious transport damage to the delivery service and to inform the provider. Failure to do so has no effect on the customer's warranty claims.

13.3. Coffee is a natural product. Differences in appearance, roast level and taste between individual harvests and roasts are typical of the product.

14. Liability and damages

14.1. The provider's liability for damage caused by slight negligence is excluded, except for personal injury and essential contractual obligations. Liability is also excluded for pure financial losses, loss of profit, damage to third parties, indirect damage and consequential damage. The provisions limiting or excluding liability in this section 14 do not apply if and insofar as the provider has acted with gross negligence or intent.

15. Dispute resolution

15.1. The provider does not take part in dispute resolution proceedings before a consumer arbitration board.

16. General provisions

16.1. Unless Austrian law already applies due to this online shop being directed at Austria, the exclusive application of Austrian law is agreed, excluding the UN Convention on Contracts for the International Sale of Goods.

16.2. For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the state in which the consumer has their habitual residence.

16.3. The customer may only set off claims against the provider's claims if those claims are legally connected with the provider's claims, have been acknowledged or have been established by a court.

16.4. The customer must notify the provider of any change of address. If the customer does not notify a change of address, a declaration sent by the provider to the most recently notified address is nevertheless deemed to have been received.

Cancellation policy (right of withdrawal)

Right of withdrawal

The term "Rücktrittsrecht" commonly used in Austria corresponds to the term "Widerrufsrecht" used in Germany and in the Consumer Rights Directive. Both terms refer to the right of withdrawal described below.

No right of withdrawal
There is no right of withdrawal for goods made to the customer's specifications or clearly tailored to personal needs.
There is no right of withdrawal for goods that can spoil quickly or whose expiry date would quickly be exceeded.
There is no right of withdrawal for leisure services (e.g. workshops, cuppings and other events) that are provided on a date specified at the time the contract is concluded.

Expiry of the right of withdrawal
For goods delivered sealed that are not suitable for return for health protection or hygiene reasons (e.g. food such as coffee in sealed packaging), the right of withdrawal expires if the seal has been removed after delivery.

Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days

  • for a contract for the sale of goods, from the day on which you, or a third party named by you who is not the carrier, take possession of the goods – for several goods in one order that are delivered separately, of the last item;
  • for a contract for the regular delivery of goods (coffee subscription), from the day on which you, or a third party named by you who is not the carrier, take possession of the first goods;
  • for a contract for services (e.g. workshops without a fixed date) or for vouchers, from the day the contract is concluded.

To exercise your right of withdrawal, you must inform us

Kaffemik GmbH
Zollergasse 5/2, 1070 Vienna, Austria
Phone: +43 660 2712997
Email: coffee@kaffemik.live

of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email). You may use the model withdrawal form below, but this is not mandatory.

You can also exercise your right of withdrawal online using the "Withdraw from contract" function at www.kaffemik.live/en/pages/widerruf-formular. If you use this online function, we will promptly send you a confirmation of receipt on a durable medium (e.g. by email) with information on the content of the declaration of withdrawal and the date and time of its receipt.

To meet the withdrawal deadline, it is sufficient for you to send your notice of exercising the right of withdrawal before the withdrawal period expires.

Consequences of withdrawal
If you withdraw from this contract, we will refund all payments we have received from you, including delivery costs (except for the additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received notice of your withdrawal from this contract. We will use the same means of payment that you used for the original transaction for this refund, unless expressly agreed otherwise with you; in no case will you be charged any fees for this refund.

We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us (Kaffemik GmbH, Zollergasse 5/2, 1070 Vienna, Austria) without undue delay and in any case no later than fourteen days from the day on which you inform us of your withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.

You bear the direct costs of returning the goods.

You are only liable for any loss in value of the goods if this loss in value is due to handling of the goods that was not necessary to examine their nature, characteristics and functioning.

If you have requested that the services begin during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of the services already provided up to the time you inform us of the exercise of the right of withdrawal with regard to this contract, compared with the total scope of the services provided for in the contract.
